Terms of Service

Effective date: August 31, 2025

These Terms of Service (“Terms”) govern your access to and use of BVRLY HEELS at bvrly-heels.com (the “Site”), and your purchase of products from us (together, the “Services”). By using the Services, you agree to these Terms and to our Privacy Policy, Refund/Returns Policy, and Shipping Policy.
If you do not agree, please do not use the Services.

1) Who we are

The Site is operated by FOP Ivanko Alevtyna Valeriivna, registered in Ukraine.

We operate the store on the Shopify platform. Shopify Inc. is not a party to your purchase contract with us.

2) Eligibility & account

You must be at least 18 (or the age of majority in your jurisdiction) to place orders. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

3) Products, pricing, and availability

  • We may change products, prices, and descriptions at any time.

  • Displayed colors may vary by screen; minor color/finish differences are not defects.

  • Made-to-order or personalized items may have slight variations due to the hand-made process.
    If we discover an error in price or availability after your order, we may cancel and refund you.

4) Orders & payment

Your order is an offer to buy; we accept it when we send an order confirmation. We may refuse/cancel any order (e.g., suspected fraud, address issues, inventory errors).
We accept the payment methods shown at checkout. Applicable taxes for your region may be charged at checkout.

Currency. Prices may be shown in multiple currencies; your card will be charged in the currency selected at checkout. If your bank operates in a different currency, exchange rates/fees are set by your bank/payment provider.

Order changes/cancellations. Contact bvrly.heelsin@gmail.com as soon as possible. We can’t guarantee changes after fulfillment has started.

5) Shipping, delivery & risk of loss

We ship from Odesa, Ukraine. Estimated delivery windows shown at checkout are estimates, not guarantees. Risk of loss passes to you when the order is handed to the carrier.

Customs & import fees (international orders). You are responsible for any import duties, VAT/GST, brokerage and customs clearance fees required by your destination country. These costs are not included in our product price or standard shipping charges. Delays caused by customs or the carrier are outside our control.

Tracking details will be provided where available. If a package is unclaimed or returned due to an incorrect/incomplete address, we can reship at your expense or refund the item price minus shipping (for non-custom items per our Refund Policy).

6) Returns, exchanges & refunds

Please review our Refund/Returns Policy before purchasing.

Hygiene note. For hygiene and safety, we cannot accept returns on underwear/bodysuits/hosiery and similar intimate apparel, except where required by law or if the item is defective on arrival.

To start a return, email bvrly.heelsin@gmail.com with your order number and photos (if relevant) within the timeframe stated in our Refund Policy.

7) Pre-orders & made-to-order

Pre-order and made-to-order items require additional production time shown on the product page. Lead times are estimates and may shift due to material or logistics constraints. Combined orders ship together unless we state otherwise.

8) Promotions, gift cards & store credit

Promotions/discount codes are subject to their terms and may be changed or withdrawn at any time. One code per order unless otherwise stated.
Store credit and gift cards are non-refundable and, unless required by law, cannot be redeemed for cash.

9) User content & reviews

If you post reviews, photos, or other content, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, and display that content in connection with the Services and our marketing, in compliance with our Privacy Policy. You represent that you own or have rights to such content and that it does not infringe others’ rights or contain unlawful material.

10) Acceptable use

You agree not to: (a) use the Services for unlawful purposes; (b) attempt to gain unauthorized access; (c) interfere with security features; (d) scrape or reverse engineer parts of the Site; (e) submit false orders/chargebacks; or (f) violate applicable sanctions/export laws.

11) Intellectual property

All content on the Site (designs, photos, text, logos) is our property or our licensors’ and is protected by IP laws. You may not use our content without prior written permission. Our product images may not be used for resale listings without consent.

12) Limited warranty; liability

Products are provided “as is” except as required by law. To the maximum extent permitted, we exclude implied warranties of merchantability/fitness and limit our liability to the amount you paid for the product that gave rise to the claim. We are not liable for indirect, incidental, special, or consequential damages (including loss of profits), except where such limitation is prohibited by law.
This clause does not affect rights you may have under mandatory consumer-protection laws in your country.

13) Force majeure

We are not responsible for delays or failure to perform due to events beyond our reasonable control (e.g., natural disasters, war, strikes, government actions, power/telecom failures, pandemics, carrier disruptions).

14) Disputes & governing law

These Terms and your purchase contract are governed by the laws of Ukraine, without regard to conflict-of-laws rules. The courts of Odesa, Ukraine, shall have exclusive jurisdiction, except where consumer-protection laws give you the right to bring claims in your home country.

If you are in the EEA/UK, you may also use the EU ODR platform to submit a complaint: ec.europa.eu/odr.
We aim to resolve issues amicably—please contact bvrly.heelsin@gmail.com before filing a claim.

15) Termination

We may suspend or terminate access to the Services for any violation of these Terms. You may stop using the Services at any time. Sections that by nature should survive (e.g., IP, limitations of liability, disputes) will survive termination.

16) Changes to the Terms

We may update these Terms from time to time. The updated version will be posted on the Site with a new “Effective date”. Material changes may be notified by email or banner. Your continued use of the Services after changes constitutes acceptance.
